Rules that apply when you use ArtCreate AI and its creative services.

These Terms of Service (Terms) govern your use of the ArtCreate AI website, creative tools, AI Agent, APIs, account features, and related services (the Service). By creating an account, purchasing a plan or credits, or using the Service, you agree to these Terms and the policies linked from them.

The legal name, address, and contact details of the operator contracting with you are shown during checkout, in your account information, or in another notice for your region. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority where you live, and able to enter a binding agreement. If you use the Service for an organization, you confirm that you can bind it.

Provide accurate information, protect your credentials, and promptly report unauthorized access. You are responsible for activity under your account unless applicable law provides otherwise. We may require verification to protect the Service or comply with law.

2. What the Service provides

The Service may provide image, video, music, transformation, media-library, and multi-step Agent workflows. Available models, parameters, speed, resolution, duration, output format, and cost may vary by region, plan, provider capacity, and product updates. Information shown in the interface when you submit a task controls that task.

AI tasks are probabilistic and may take time, fail, be delayed, or produce unexpected, inaccurate, or similar results. Agent plans and outputs may require your review and are not professional, legal, medical, or financial advice.

3. Your content and instructions

You retain the rights you already have in prompts, uploads, instructions, and other material you submit (Input). You grant us and our service providers a worldwide, non-exclusive license to host, copy, transmit, modify, and process Input only as reasonably necessary to provide, secure, support, and improve the Service as described in our Privacy Policy.

You confirm that you have all rights, permissions, notices, and consents needed for your Input and requested use, including for people, voices, faces, brands, music, and copyrighted material depicted or uploaded.

Rights in generated results (Output) depend on applicable law, your contribution, the selected model/provider terms, and any restrictions shown when you generate. Our AI Output & Content License explains what ArtCreate AI can grant and the limits that apply.

4. Acceptable use

You must not use the Service to:

  • break the law or violate intellectual-property, privacy, publicity, confidentiality, or other rights;
  • exploit or sexualize minors, create non-consensual intimate content, facilitate trafficking, or depict child sexual abuse material;
  • impersonate, defraud, harass, threaten, discriminate against, or mislead people, including through deceptive synthetic media;
  • create a person's face, voice, or digital replica without the authority and disclosures required for that use;
  • facilitate violence, self-harm, dangerous activity, malware, unauthorized surveillance, spam, or evasion of safety controls;
  • probe, disrupt, scrape, overload, reverse engineer, resell, or provide unauthorized access to the Service, except where law expressly permits; or
  • use Output as the sole basis for high-impact decisions about employment, housing, credit, education, healthcare, insurance, legal rights, or access to essential services.

We may block content, limit functionality, investigate activity, or suspend accounts to enforce these rules and protect users, providers, and the public.

5. Credits, plans, and payment

Credits are service units used to submit eligible tasks. They are not money, stored value, or property, and are not transferable unless the Service expressly says otherwise. The task screen or checkout page shows the applicable price, credit cost, renewal terms, taxes, and expiration or rollover rules before purchase or submission.

Completed or provider-accepted tasks may consume credits even if the result does not match your aesthetic preference. Where our systems identify a qualifying technical failure, credits may be restored according to the displayed task rules. Credits may expire based on the plan or purchase terms shown to you.

Subscriptions renew only as disclosed at checkout. You can cancel future renewal through the available billing controls or Support; cancellation normally takes effect at the end of the paid period unless the interface states otherwise. Refunds are governed by our Refund Policy and mandatory consumer law.

6. Third-party services

The Service depends on third-party AI models, payment processors, hosting, storage, authentication, analytics, and other providers. Their terms or acceptable-use rules may also apply to your use. We are not responsible for third-party services outside our control, and a provider may change or withdraw a model.

7. Intellectual property

The Service, interface, software, brand, documentation, and original platform content belong to the operator or its licensors. Except for the limited right to use the Service under these Terms, no platform intellectual-property rights are transferred to you.

If you submit feedback, you allow us to use it without restriction or payment, but we will not identify you publicly without permission.

8. Suspension and termination

You may stop using the Service at any time. We may restrict or terminate access for a material breach, unlawful or unsafe conduct, non-payment, security risk, legal requirement, or discontinuation of the Service. Where reasonable and lawful, we will provide notice and an opportunity to export available content or appeal through Support.

Terms that by their nature should survive termination—including payment obligations, licenses needed to handle prior activity, disclaimers, liability limits, and dispute provisions—will survive.

9. Disclaimers

To the maximum extent permitted by law, the Service is provided as available and without warranties not expressly stated here. We do not guarantee uninterrupted access, permanent storage, model availability, output accuracy, uniqueness, non-infringement, copyrightability, or fitness for a particular purpose. You must review Output before publishing or relying on it.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive loss, or loss of profits, data, goodwill, or business opportunity. Our aggregate liability arising from the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim.

These limits do not apply where prohibited, including liability that cannot be limited for fraud, willful misconduct, death or personal injury, or mandatory consumer rights.

11. Changes and service updates

We may update the Service and these Terms. Material changes will be announced as required by law and will apply prospectively from the stated effective date. If you do not agree to a material change, you should stop using the Service and cancel future renewal before it takes effect.

12. Disputes and governing terms

The governing law and competent forum are those identified by the contracting operator in the checkout or account information made available to you. Mandatory protections and local courts available to consumers remain unaffected. Before filing a claim, please contact Support so we can try to resolve the issue informally.
